Pink Card User Agreement

This Pink Card User Agreement (the “Agreement”) is a binding legal contract between you (“you”, “your” or the “Cardholder”) and the operator of Pink Card (“Pink Card”, “we”, “us” or “our”). It governs your purchase and use of the prepaid virtual card products and related services made available through this website. Please read this Agreement carefully and in full before purchasing or using a Pink Card. By purchasing, activating, or using a Pink Card, you confirm that you have read, understood, and agree to be bound by every provision of this Agreement. If you do not agree, do not purchase or use the card.

1. Acceptance of the Agreement

This Agreement takes effect on the date you first purchase, activate, or use a Pink Card, whichever occurs first, and remains in effect for as long as you hold any Pink Card or balance. By completing a purchase you represent that you have the legal capacity to enter into this Agreement and that you accept it on your own behalf.

We may make this Agreement available in more than one language for convenience. The English-language version is the controlling and authoritative version. In the event of any conflict, inconsistency, or difference of interpretation between the English version and any translation, the English version prevails.

Your continued use of any Pink Card after changes to this Agreement become effective constitutes your acceptance of those changes. If you do not agree with any change, you must stop using the card.

2. Definitions

  • “Pink Card” or “Card” means a prepaid, single-use or limited-use virtual payment card product issued or distributed through this website, including its 16-digit card number, expiration date, and security code.
  • “Card Information” means the card number, expiration date, security code (CVV/CVC), and any associated credentials required to use the Card.
  • “Face Value” means the nominal spending value you select and purchase at the time of order (for example, US$100, US$500, US$1,000, US$2,000, or a custom amount).
  • “Available Balance” means the remaining spendable amount on the Card after deducting transactions, holds, and applicable fees.
  • “Transaction” means any attempt to use the Card to authorize, pay for, or reserve funds for goods or services, whether such attempt is approved, declined, reversed, or returned.
  • “Merchant” means any third party that accepts or attempts to process the Card as a means of payment.
  • “Services” means the sale, delivery, and servicing of Pink Cards and any related features offered through this website.

3. Eligibility

To purchase or use a Pink Card you must be at least eighteen (18) years of age (or the age of majority in your jurisdiction, if higher) and must have the legal capacity to enter into a binding contract. You must not be a person barred from receiving the Services under the laws of your jurisdiction or any applicable jurisdiction.

You are solely responsible for determining whether your purchase and use of a Pink Card is permitted under the laws, regulations, and rules that apply to you, including any currency-control, import, tax, or financial-services rules. The availability of the Card in any location is not, and must not be construed as, an offer or solicitation where such offer or solicitation is unlawful.

4. Nature of the Card

The Pink Card is a prepaid spending instrument funded in advance by you. It is not a credit card, charge card, or line of credit, and it does not provide a deposit account or pay interest. We are not a bank and the Card does not represent a bank deposit. The Card is intended for online purchases at participating merchants and may not be accepted everywhere.

  • Non-reloadable. Once the Available Balance is depleted, the Card cannot be topped up or recharged. To continue making purchases you must buy a new Card.
  • Limited acceptance. Acceptance of the Card is determined solely by each Merchant and its payment processors. We do not control, and cannot guarantee, that any particular Merchant will accept the Card.
  • No cash access. The Card may not be used to obtain cash, cash equivalents, or to fund wagering, gambling, or money-transfer services unless expressly permitted.

5. Purchase, Issuance, and Delivery

When you place an order you select a Face Value and a payment method (for example, cryptocurrency such as USDT/USDC, or another method we make available). After we confirm receipt of your payment, the Card Information is generated and delivered to the email address you provide.

You are solely responsible for the accuracy of the delivery email address. If you enter an incorrect address, the Card Information may be delivered to someone else and the value of the Card may be irretrievably lost. We are not responsible for any loss arising from an incorrect, mistyped, or inaccessible email address that you supplied.

Card Information is sensitive. Treat it like cash. Anyone who obtains your Card Information can spend the Available Balance. We will never be liable for unauthorized use that results from your failure to keep Card Information confidential.

6. Fees and Charges

By purchasing and using a Pink Card you agree to the fees set out in this Section. Fees are deducted from the Available Balance, charged at the time of the relevant event, or collected at the time of purchase, as applicable. All fees are stated in U.S. dollars unless otherwise indicated.

(a) Per-Transaction Fee — US$1.00 per Transaction

A processing fee of US$1.00 is charged for every Transaction made or attempted with the Card. This fee applies to each Transaction regardless of its outcome — it is charged whether the Transaction is approved and successful, or declined, rejected, failed, or otherwise unsuccessful. Each authorization attempt is a separate Transaction and may incur a separate US$1.00 fee. Because declined and failed attempts are billable, repeated attempts on a Card with an insufficient balance, an incorrect entry, or at a non-accepting Merchant will each reduce your Available Balance by US$1.00.

(b) Purchase Refund Fee — 20% + US$3.00

Refunds of purchases are processed manually and are not automatic. Where a refund is approved by us, a refund handling fee equal to twenty percent (20%) of the refunded amount, plus a fixed authorization fee of US$3.00, applies and is deducted from the amount returned. For example, on a US$100.00 refund the total fee is US$23.00 (US$20.00 + US$3.00) and you would receive US$77.00. Refunds are returned in the manner and currency we determine, and processing times depend on manual review and third-party settlement.

(c) Payment-Method Surcharges

Certain payment methods carry an additional surcharge that is shown to you before you confirm payment. For example, where WeChat Pay is offered, an additional service fee of approximately 3% may apply, and the payable amount is converted to the relevant local currency at the then-current exchange rate. Network, blockchain, or gas fees associated with cryptocurrency payments are borne by you.

(d) Non-Refundable Balance and Expiration

The Card is non-reloadable. Any Available Balance that remains unused — including after expiration, depletion below a usable amount, or termination — is non-refundable and is forfeited, except to the extent a refund is expressly required by mandatory applicable law.

We may add, change, or remove fees from time to time. Changes take effect when posted or otherwise communicated, and they apply to Transactions and events occurring after the effective date.

7. Permitted Use

You may use the Pink Card only for lawful purchases of goods and services from Merchants that accept the Card, and only in compliance with this Agreement, the rules of the relevant card network, and all applicable laws. You agree to use the Card honestly, in good faith, and for genuine personal or business transactions.

8. Prohibited and Unlawful Use

You must not use, attempt to use, or permit any other person to use the Pink Card for any unlawful, fraudulent, abusive, or prohibited purpose. Without limiting the foregoing, you must not use the Card in connection with:

  • any activity that is illegal, criminal, or that would aid, facilitate, or further any crime under the laws applicable to you or to any party to the Transaction;
  • money laundering, terrorist financing, sanctions evasion, bribery, corruption, or the proceeds of any unlawful activity;
  • fraud, deception, identity theft, unauthorized use of another person's payment credentials, or any misrepresentation;
  • the purchase or sale of goods or services that are illegal where you are located or where the Merchant operates, including controlled substances, weapons, stolen goods, counterfeit items, or child sexual abuse material;
  • transactions with individuals, entities, or jurisdictions that are subject to economic or trade sanctions, embargoes, or restrictions;
  • circumventing, testing, probing, or attempting to defeat any security, verification, monitoring, or risk-control measure;
  • any use that violates the rules of a card network, a Merchant's terms, or any third-party payment processor's requirements; or
  • any use intended to obtain a financial advantage through abuse of declines, chargebacks, refunds, promotions, or fee structures.

You are solely and fully responsible for how you use the Card. Any misuse, illegal use, or improper use of the Card is your responsibility alone and is entirely unrelated to us. We do not monitor, endorse, or take responsibility for the purchases you choose to make, and we expressly disclaim any liability arising from your use or misuse of the Card. You agree that we bear no responsibility whatsoever for the legality, quality, safety, or delivery of any goods or services you purchase.

9. Compliance, Identity Verification, and Sanctions

We and our partners are subject to laws and rules concerning anti-money laundering, counter-terrorist financing, sanctions, and fraud prevention. To comply, we may, at any time and in our sole discretion, request information or documents from you, verify your identity, screen Transactions, impose limits, delay or decline Transactions, freeze a balance, or suspend or terminate your access to the Services.

You represent and warrant that you are not located in, organized under the laws of, or ordinarily resident in any jurisdiction subject to comprehensive sanctions, and that you are not a person with whom we are prohibited from dealing. You agree to provide truthful, accurate, and complete information whenever requested, and to update it promptly when it changes.

10. Authorizations, Holds, and Declines

When you use the Card, a Merchant may request an authorization for an amount equal to or greater than the purchase, which temporarily reduces your Available Balance. Authorization holds may persist for a period determined by the Merchant and the card network, even if the underlying purchase does not complete.

A Transaction may be declined for many reasons, including insufficient Available Balance, expiration, suspected fraud, Merchant or network restrictions, technical errors, or compliance controls. We are not responsible for any loss, inconvenience, or damage resulting from a declined or delayed Transaction, and, as set out in Section 6, the US$1.00 per-Transaction fee may apply to declined attempts.

11. Refunds, Cancellations, and Chargebacks

Before delivery — that is, before the Card Information email has been sent — you may contact support to cancel your order for a refund to the original payment method, subject to any network or payment-processor costs. Once the Card Information has been delivered, the product is deemed delivered and, due to the nature of the product, orders are generally non-cancellable and non-refundable.

Merchant refunds are handled by the Merchant under the Merchant's own policy and are then processed by us manually, subject to the refund fee described in Section 6(b). We do not control whether or when a Merchant issues a refund. You must resolve disputes about goods or services directly with the Merchant; we are not a party to your purchase and have no obligation to mediate, reverse, or guarantee any Transaction.

12. Your Responsibilities and Security

  • keep your Card Information, delivery email, and any credentials secure and confidential;
  • verify all order details — including Face Value, payment amount, and delivery email — before you confirm payment;
  • monitor your Available Balance and Transaction activity;
  • comply with all applicable laws and with the terms of every Merchant with whom you transact; and
  • promptly notify us of any suspected loss, theft, or unauthorized use of your Card Information.

You assume full responsibility for all Transactions made with your Card Information. Because the Card functions like cash, we may be unable to recover or replace value that is lost or spent due to disclosure of your Card Information or errors that you make.

13. Risk Disclosure

Using a prepaid card and funding it with cryptocurrency or other methods involves risk. Exchange rates, network fees, Merchant acceptance, and settlement times are outside our control and may change. Cryptocurrency transactions are generally irreversible. You accept these risks and acknowledge that the value you receive may differ from the value you expect due to fees, conversions, and third-party charges.

14. Third-Party Services

The Services rely on third parties, including card issuers, networks, payment processors, and Merchants. Your use of any third-party service is governed by that party's own terms. We are not responsible for the acts, omissions, products, services, or policies of any third party, and references to third parties do not imply endorsement.

15. Service Availability

We provide the Services on an “as is” and “as available” basis. We do not warrant that the Services or any Card will be uninterrupted, error-free, secure, or available at any particular time or location. We may modify, suspend, or discontinue any feature of the Services at any time without liability.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty regarding any goods or services you purchase with the Card, the conduct of any Merchant, or the results you may obtain from using the Card.

17. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we, our affiliates, or our partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Services or this Agreement, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to a Card or this Agreement will not exceed the Face Value of the specific Card giving rise to the claim. Some jurisdictions do not allow certain limitations; in such cases the limitations apply to the fullest extent permitted.

18. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, and our partners from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to your use or misuse of the Card, your breach of this Agreement, your violation of any law or third-party right, or any Transaction you initiate.

19. Suspension and Termination

We may suspend, restrict, freeze, or terminate your access to the Services, or cancel or void a Card, at any time and without prior notice, if we reasonably suspect fraud, unlawful activity, breach of this Agreement, or risk to us, a Merchant, a network, or any other person, or where required to comply with law. Termination does not entitle you to a refund of any fee or of any forfeited balance, except where mandatory law requires otherwise.

20. Privacy

We collect and process information necessary to provide the Services, prevent fraud, and comply with law. By using the Services you consent to such collection and processing. We may share information with issuers, processors, networks, and authorities as needed to operate the Services and meet our legal obligations.

21. Changes to this Agreement

We may amend this Agreement at any time by posting the revised version with an updated “Last updated” date. Changes are effective when posted unless we state otherwise. It is your responsibility to review this Agreement periodically. Your continued purchase or use of a Card after changes take effect constitutes acceptance of the revised Agreement.

22. Governing Law and Dispute Resolution

This Agreement and any dispute arising out of or relating to it or the Services are governed by the laws applicable to the operator of Pink Card, without regard to conflict-of-laws principles. You agree to first attempt to resolve any dispute informally by contacting us. If a dispute cannot be resolved informally, it will be resolved by binding arbitration or by the competent courts at our principal place of business, to the extent permitted by applicable law. To the extent permitted by law, you waive any right to participate in a class or representative action.

23. General Provisions

  • Entire Agreement. This Agreement, together with any order details and policies referenced at the point of purchase, constitutes the entire agreement between you and us regarding the Card and supersedes prior understandings.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign or transfer this Agreement without our consent. We may assign it without restriction.
  • Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
  • Headings. Section headings are for convenience only and do not affect interpretation.
